Legal terms governing the use of Dalbit Paceworks software for speedrunning practice and timing. Acceptable use, account rules, content ownership, and disclaimers.
1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Dalbit Paceworks software, websites, and related services (collectively, the "Service"). By creating an account or by accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. The Service is operated by Dalbit Paceworks Co., Ltd., a company registered in the Republic of Korea (registration number 124-86-73952), with its principal place of business at 7F, 18 Seongsui-ro 10-gil, Seongdong-gu, Seoul 04784, Republic of Korea. These Terms are effective as of March 1, 2025.
2. Eligibility and Account Registration
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your country of residence, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. When you register an account, you agree to provide accurate, current, and complete information and to keep that information up to date. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at [email protected] if you suspect any unauthorized use of your account. We reserve the right to suspend or terminate any account that violates these Terms, appears to be created by automated means, or misrepresents identity or affiliation.
3. Acceptable Use

Cheating and Automation
You may not use macros, scripts, memory readers, or any external tools to manipulate timing, splits, game state, or leaderboard data within the Service. This includes any action that gives you an unfair advantage in practice or competition.

Abusive Behavior
You may not harass, threaten, impersonate, or otherwise harm other users. We enforce a zero-tolerance policy for hate speech, doxxing, and targeted harassment within any community feature or shared content.

Reverse Engineering
You may not decompile, disassemble, reverse engineer, or attempt to extract the source code of the Service, except to the extent explicitly permitted by applicable law.

Circumventing Restrictions
You may not bypass any technical restrictions, rate limits, or security measures implemented by the Service, including the use of VPNs to circumvent regional license or content restrictions.

System Abuse
You may not interfere with the operation of the Service, overload servers, send spam, or transmit viruses, worms, or other malicious code. Any automated scraping or data mining is prohibited without our prior written consent.

Account Trafficking
You may not sell, transfer, or lend your account to another person. Accounts are personal and non-transferable. Any such action will result in immediate termination.
4. Content Ownership and Route Notes
The Service allows you to create, upload, and share route notes, split files, timestamps, comments, and other user-generated content ("User Content"). You retain all intellectual property rights in your User Content. By submitting User Content to the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, reproduce, distribute, and perform your User Content solely for the purpose of operating, providing, and improving the Service. This license does not grant Dalbit Paceworks the right to use your content in unrelated marketing materials without your separate consent.
You represent and warrant that your User Content does not infringe the rights of any third party, including copyright, trademark, privacy, or publicity rights. We do not claim ownership over your route notes—they remain yours. However, we reserve the right to remove or moderate any User Content that violates these Terms, applicable law, or is otherwise objectionable. If you believe that content on the Service infringes your copyright, please contact us as described in Section 9.
5. Support Limits
Dalbit Paceworks offers technical support on a best-effort basis. Support is generally available during business hours (09:00–18:00 KST, Monday through Friday, excluding South Korean public holidays). Response times are not guaranteed; we aim to respond within 1–2 business days. We do not provide 24/7 support and may not resolve all reported issues. The Service is provided "as is" and we do not warrant that it will be error-free, uninterrupted, or meet your specific requirements. If you have purchased a premium plan (if offered), we may prioritize support requests but still provide no formal service-level agreement (SLA). To request assistance, please email [email protected] and include your account email and a detailed description of the issue.
6. Disclaimers and Limitation of Liability
To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be secure, accurate, or error-free, or that defects will be corrected.
In no event shall Dalbit Paceworks, its officers, directors, employees, or affiliates be liable to you for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to your access to or use of the Service. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you have paid us, if any, in the twelve months preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above may not apply to you.
7. Governing Law and Dispute Resolution
These Terms and any disputes arising out of or relating to them shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of laws principles. Any dispute shall first be resolved through good-faith negotiations between the parties. If the dispute cannot be resolved within 30 days of the start of negotiation, the dispute shall be submitted to binding arbitration in Seoul, Korea, in accordance with the Korean Commercial Arbitration Board rules. The language of arbitration shall be English. You agree that any claims shall be brought in your individual capacity, and not as a plaintiff or class member in any purported class action or representative proceeding.
8. Changes to These Terms
We may revise these Terms from time to time. We will notify you of material changes by email (to the address on file) or by posting a notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account. We encourage you to review these Terms periodically.
